These Terms of Use (hereinafter the "Terms") govern access to and use of the eSki online platform (website and any applications, hereinafter the "Platform") by users (hereinafter the "Users").

The eSki Platform provides Users with the ability to search, compare, and make online bookings for ski and snowboard equipment at partner stores (hereinafter the "Partners"). eSki acts exclusively as an intermediary/mediator between Users and Partners, facilitating the booking and payment process through its system.

By creating an account and/or making a Booking through the Platform, the User voluntarily declares that they have read, understood, and accept these Terms, as well as the Privacy Policy, the Cookies Policy, and the Cancellation Policy of eSki, as they may be in force from time to time.

Acceptance of the Terms does not create an employment, cooperation, representation, or partnership relationship between the User and eSki.

1. Definitions

For the purposes of these Terms, the following terms have the meaning attributed below:

  • Platform: The totality of electronic services offered under the eSki trademark, including the website www.eskirental.com and any related web or mobile application that enables use of its services.
  • User: Any natural person who gains access to the Platform, whether for browsing or for making a Booking, provided that they have reached the age of 18 and have full legal capacity.
  • Equipment: The totality of ski or snowboard items and related accessories (indicatively: poles, helmet, goggles, gloves, etc.) offered for rental through the Platform by eSki's Partners. The equipment remains the property of the respective Partner and is made available to the User exclusively for temporary use, in accordance with the terms of the Booking and the Partner's policy.
  • Partner: Any business or natural person cooperating with eSki for the rental of ski, snowboard, or related equipment.
  • Services: The totality of functions provided by the Platform to Users and Partners, including searching, comparing, booking, and paying for equipment.
  • Booking: The electronic process of selecting, pre-reserving, and paying for equipment through the Platform.
  • Account: The User's profile on the Platform.

2. Scope & Nature of the Service

eSki is an online platform through which Partners display the availability of their equipment and Users can search, compare, and make Bookings for ski, snowboard, and related equipment.

Upon completing a Booking, the User directly enters into a binding service/rental contract with the respective Partner. eSki acts exclusively as an intermediary and facilitator of the Booking and payment process, transmitting Booking details to the Partner and sending relevant confirmations or updates to the User.

The information displayed on the Platform comes from two sources:
(a) data entered by Partners through the eSki system (indicatively: availability, prices, equipment types), and
(b) content shaped or approved by eSki itself (indicatively: service descriptions, policies, payment process, general operating terms).

Partners bear exclusive responsibility for the accuracy and currency of the data they enter. eSki makes every reasonable effort to ensure correct and timely display of information on the Platform, but cannot guarantee that third-party information is at all times accurate, complete, or error-free.

The Platform and its services are provided exclusively for personal, non-commercial use. Resale, automated data extraction, copying, public reproduction, or any use for competitive purposes without prior written consent from eSki is prohibited.

Any attempt at reverse engineering, disassembly, decoding, or other interference with the operation or source code of the Platform, as well as its use in a manner that violates applicable law, public morals, or third-party rights, is prohibited.

3. Privacy Policy

The management of personal data is governed by eSki's Privacy Policy (collection, use, storage, rights). Users can find detailed information in the relevant section.

4. Booking Process

Booking through the Platform is completed through the following steps:

  1. Search for ski resort and dates
    The User selects the ski resort and the rental dates.
  2. Entry of biometric data and other equipment fitting information
    The User enters details such as height, weight, experience level, shoe size, and other information required for recommending suitable equipment.
  3. Partner selection
    The Platform displays available Partners.
  4. Equipment package selection
    The User selects the type or package of equipment they wish.
  5. Booking Cart
    The User reviews the Booking summary and proceeds to payment.
  6. Payment and Confirmation
    Payment is made through Viva Wallet. Upon completion of the transaction, the Booking is recorded in the system and the User receives an electronic confirmation with its key details.
  7. Preparation & Collection
    The Partner receives the Booking from the Platform and prepares the equipment. Upon collection, the User provides the Booking ID and their full name . Depending on the store's policy, an ID or other official document may be requested exclusively for verification purposes.

Electronic confirmations & notifications
eSki sends confirmations and updates to the User's confirmed email address. The User must keep their contact details active and accessible and check any spam folders or provider filters/settings. Failure to receive or read an email due to security settings, filters, or technical issues with third-party providers does not affect the validity of the Booking, provided payment has been completed and the Booking has been successfully registered.

5. User Obligations

The User must submit truthful, accurate, and complete information when using the Platform and during the Booking process.

The information requested for equipment selection/recommendation is used to correctly propose and adjust the appropriate equipment. eSki bears no responsibility for inaccurate or incomplete data that may affect the selection or adjustment of equipment.

The User is also obliged to collect and return the equipment within the agreed dates and during the operating hours of the respective store, to return the equipment in the condition received (excluding normal wear and tear), and to immediately notify the Partner in the event of loss, damage, or malfunction of the equipment.

The User is liable to the respective Partner for the correct use and return of the equipment in accordance with the Partner's policy. In the event of damage, loss, theft, non-return, or return with deficiencies, the Partner may request compensation and/or additional charges from the User as provided by their policy. eSki is not involved in financial settlements between the User and Partner for such incidents, but may assist in facilitating communication.

6. Pricing

The prices displayed on the Platform and clearly stated for the Equipment are set exclusively by the Partners and include all applicable taxes, unless otherwise stated.

Prices are binding only after the Booking is completed and confirmed. Obvious or technical errors regarding prices, availability, or calculations are not considered binding and may be corrected.

eSki may charge a separate service fee for use of the Platform/processing of the Booking/management of the transaction. Any such charge is displayed separately before payment is completed.

7. Payments

Payments for Bookings through the Platform are made exclusively electronically, through Viva Wallet (payment services provider). Payment is considered completed once confirmed by the payment provider.

eSki does not store or process credit or debit card details. These details are submitted to and held exclusively by the payment provider.

9. Intellectual Property

All content of the eSki Platform, such as logos, trademarks, texts, photographs, data, databases, and software, belongs to eSki or its rightful owners and is protected by applicable intellectual and industrial property law.

Total or partial copying, republication, modification, or reproduction of the content without prior written consent from eSki is prohibited.

10. Limitation of Liability

eSki operates exclusively as an intermediary. Responsibility for the quality, condition, suitability, and maintenance of the equipment lies exclusively with the respective Partner.

eSki provides the Platform "as is" and "as available", without any warranty for continuous, uninterrupted, or error-free operation.

eSki bears no liability for damages, damage to equipment, accidents, or incidents arising from use of the equipment, inaccurate information entered by Partners and/or Users, delays, technical problems, or service interruptions, force majeure events or malfunctions of third-party providers (indicatively: internet or payment service providers), indirect or consequential damages, loss of income, or lost profits.

In no event shall eSki's liability exceed the amount of the commission/service cost collected for the specific transaction, to the extent permitted by applicable law.

Any claim related to the operation of the Platform or eSki's services must be submitted in writing within thirty (30) days of the incident, to the extent that this does not conflict with mandatory consumer protection provisions.

11. Misuse

eSki monitors the proper use of the Platform and reserves the right to take action in cases of fraud, misuse, or violation of these Terms or applicable law.

In such cases, eSki may proceed with suspension or termination of access and/or cancellation of an account where deemed necessary, and may notify the relevant authorities where required.

12. Modifications to Terms

eSki may revise or modify these Terms of Use at any time. Each updated version will be published on the Platform and will bear a renewed effective date.

Continued use of the Platform after the publication of changes implies acceptance of the new Terms.

13. Applicable Law & Jurisdiction

These Terms, as well as any dispute arising from the use of the Platform or eSki's Services, are governed by Greek Law.

The Courts of Corinth are competent to resolve any related dispute, with an express waiver of any other jurisdiction, unless otherwise stipulated by mandatory provisions of law.

14. Communication & Automated Support (AI Agent)

The User accepts that any communication relating to Bookings, payments, or Platform updates may be carried out electronically, via email or notifications within the Platform, and that such communications have legal effect. The User is responsible for keeping their contact details active and accurate.

eSki may provide a support function through an automated assistant (AI Agent). The AI Agent's responses are automated and may not always be accurate or complete; they do not constitute binding information or legal advice.
